Terms of Service · version 1 · effective October 9, 2026
The agreement for using Map Scouts
These Terms of Service are an agreement between you and Here Now Labs, Inc., a Delaware corporation ("Here Now Labs", "we", "us"), about your use of Map Scouts: the websites mapscouts.com and teach.mapscouts.com, the Map Scouts student experience, the teacher portal, and related services (the "Service"). By creating a Map Scouts account or using the teacher portal, you agree to these Terms and to the Privacy Policy. If you do not agree, do not create an account.
What changed on October 14, 2026: the product is now called Map Scouts. The terms are the same.
What changed on October 9, 2026: this is now version 1 (no longer a draft). It names QuestVille instead of "the game"; describes the free unit, school licenses and card payments (Stripe); and describes the emails we send teachers (each non-essential one has an unsubscribe link), the note colleagues get when you join, and funding requests a teacher sends through Map Scouts. Nothing changed about student data.
1. Who may use the teacher portal
- You must be at least 18 years old and a teacher, school administrator, or other school or district staff member (or a person acting under a school's direction, such as a student teacher or an education nonprofit's staff supporting a school).
- You represent that you are using the Service for your school's educational purposes and that your school or district authorizes you to use classroom tools of this kind with students.
- Students never create accounts. Students use Map Scouts in class through a class code their teacher shares, under the teacher's supervision. Students are not parties to these Terms.
2. Your account
- Sign-in is by a link or code sent to your email. You are responsible for the email account you use and for what happens under your Map Scouts account. Tell us at team@herenowlabs.xyz if you believe your account has been used without your permission.
- Give us accurate information (your name as students know you, your school, your town).
- Co-teachers you add to a class are bound by these Terms when they sign in.
- We send you sign-in and account emails, and some emails about getting started and using Map Scouts. You can unsubscribe from the second kind in any of them.
- Requests you send. When you send a funding request through Map Scouts, we email it in your name to the people you choose. You confirm that you may contact them about your school's use of Map Scouts and that what you add to the request is accurate.
3. Students and student data
- What you may enter about a student: a first name, and a last initial only when two students share a first name. Do not enter last names, birthdates, contact details, identification numbers, health or disability information, or anything else about a student. The roster field is built for first names only.
- School authority. You and your school, not Here Now Labs, decide which students use Map Scouts. Where consent to the collection of a student's information is required (for example under the Children's Online Privacy Protection Act), your school provides it for the school's educational purpose, as permitted for schools, and you confirm your school has done so or is able to do so. Here Now Labs does not seek consent from students or parents directly.
- Our role. For student data, Here Now Labs acts as a service provider to your school, as a "school official" with a legitimate educational interest under FERPA, using student data only to provide the Service to your school and class, under the school's direct control, and as described in the Privacy Policy. Student data belongs to the school.
- No sale, no advertising, no profiling. We never sell student data, never use it for advertising, never build a profile of a student for any purpose other than showing a teacher that student's progress in the Service, and never use student data to train or improve machine-learning models.
- Student Data Privacy Agreement. If your school or district requires a student data privacy agreement, we will sign the Massachusetts Student Privacy Alliance's standard agreement (or another agreement we accept in writing). Where such an agreement is signed, it governs student data and takes precedence over these Terms for your school.
- Deletion and access. You can delete a class at any time, which deletes its roster and all of its students' activity. Your school may ask us to delete or export a student's or a class's data at any time (team@herenowlabs.xyz); we act within 30 days of a verified request.
4. Acceptable use
Do not: use the Service for anything other than teaching and learning; enter data about students beyond what section 3.1 allows; try to access another school's classes or data; interfere with the Service, probe its security, or circumvent rate limits; copy, scrape, or resell the Service or its content; or use the Service in a way that violates law or a student's rights. We may suspend or close an account that does.
5. Content
- Ours. Map Scouts’ maps, stories, cards, lessons, software, and design are owned by Here Now Labs or its licensors. We give you a limited, non-exclusive, non-transferable license to use them with your classes while you have an account. Map data is © OpenStreetMap contributors (ODbL); other third-party material is credited where it appears.
- Yours. Material you contribute (for example a slideshow you share with us so we can turn it into lessons) stays yours. By sharing it you give us permission to use it to build and improve Map Scouts’ lessons, credited to you only with your agreement. Tell us if you want material removed.
- Student work. Students' answers and progress are student data (section 3), not "content" under this section.
6. Privacy
The Privacy Policy explains what we collect from teachers and about students, why, who sees it, how long we keep it, and how it is protected and deleted. It is part of these Terms.
7. Free units, school licenses, and changes to the Service
- Free units. A teacher with a school email address may start one free unit: one unit, with one class, until the end date shown when you press Start (the end of the school term, and never less than 16 weeks). Sending a funding request through Map Scouts earns one more free unit, once, whatever the answer. A free unit also covers the co-teachers of that class. The chapter a class is in the middle of may be finished after a free unit ends.
- School licenses. The full library is licensed to a school or district, never to a teacher; teachers are never charged. A license's price, term and payment terms are the ones in the quote, approval or invoice the school or district accepts, and those terms govern fees and payment. Card payments are processed by Stripe. Pilot schools have a license at no charge for the period we agreed with them.
- Changes. We may change what the free offer includes for units not yet started; a free unit already started keeps its end date. We may change, pause, or stop features or the Service, and will give schools with active classes reasonable notice of a shutdown and a way to export their data before it is deleted.
8. Disclaimers
The Service is provided "as is" and "as available." We do not promise that it will be uninterrupted, error-free, or that any content is complete or suitable for a particular lesson; teachers remain responsible for how the Service is used in their classrooms. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, Here Now Labs will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising from the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount your school paid us for the Service in the twelve months before the claim or one hundred U.S. dollars ($100). Nothing in these Terms limits liability that cannot be limited by law, and nothing in them limits our obligations for student data under a signed Student Data Privacy Agreement.
10. Ending the agreement
You may stop using the Service and ask us to delete your account at any time. We may close an account for a breach of these Terms. When an account is closed, its classes and student data are deleted as the Privacy Policy describes, unless your school has asked us in writing to transfer them to another account at the school.
11. Changes to these Terms
We may update these Terms. For a material change we will email account holders at least 30 days before it takes effect and ask you to accept the new version at your next sign-in. Continuing to use the Service after a change takes effect means you accept it.
12. Law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Delaware, and both parties consent to that venue, except that a school or district's signed Student Data Privacy Agreement may provide otherwise for matters it covers.
13. General
These Terms and the Privacy Policy are the whole agreement between you and Here Now Labs about the Service, except for any signed Student Data Privacy Agreement. If a part of these Terms is found unenforceable, the rest stands. You may not assign these Terms; we may assign them to a successor that takes on our obligations, with notice to account holders.
